We will refer to the Site and related services offered through the Site as the “Services.” This Privacy Policy applies to all visitors, users, and others who access the Services, including brands who use Digiphy to promote their products, and individuals who visit the Site or related Services or contact Digiphy support.

We collect information in several ways to digitally connect our brand customers (each a “Partner Brand”) with their consumers, and to enhance your experience with Digiphy.

INFORMATION WE OBTAIN FROM OTHERS

Information we obtain from social media platforms. We may maintain pages for Digiphy on social media platforms, such as Facebook, LinkedIn, Twitter, Google, YouTube, Instagram, and other third-party platforms. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use and processing of your Personal Information in accordance with your privacy settings. You or the platforms may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy.

Information we obtain from other third parties. We may receive Personal Information about you from third-party sources. For example, a business partner may share your contact information with us if you have expressed interest in or may benefit from our Services. We may obtain your Personal Information from other third parties, such as marketing partners, publicly available sources and data providers.

COOKIES, WEB BEACONS, AND OTHER INFORMATION COLLECTED BY AUTOMATED MEANS

We, our Service Providers, and our business partners may automatically log information about you, your computer or mobile device, and activity occurring on or through the Services. To the extent we deliver marketing emails, you may change your communication preferences to opt out of marketing emails, but please be aware that you cannot opt out of receiving service messages from us, including security and legal notices.

3. HOW WE SHARE YOUR INFORMATION

Partner Brands use our Services to connect and engage with their customers, and vice versa. We may share the Personal Information we collect from and about you (1) if you are a consumer, with our Partner Brands, to provide them with our Services and with analytics regarding audience engagement with their products and product materials; (2) if you are a Partner Brand, with our business or marketing partners, with your consent; (3) for legal and safety purposes, including in response to lawful requests by public authorities to meet national security, law enforcement, or other requirements; (4) to protect the rights of Digiphy, our agents, customers, and others, including by enforcing our agreements and policies; (5) with a new owner if the ownership or control of all or part of our Services changes; and/or (6) with third parties we contract with to perform functions related to the Services (“Service Providers”). Service Providers will have access to your Personal Information needed to perform their business functions, but may not use or share that Personal Information for purposes outside the scope of their functions related to the Services.

4. LINKS TO OTHER SITES

The Services may contain links to other third-party sites. Any information you provide on those sites is subject to that third party’s privacy policy. Our Privacy Policy does not apply to such sites, and we are not responsible for the privacy and security practices and policies of those third-party sites.

5. CHILDREN

The Services are not directed to children and children are not eligible to use the Services. We do not collect or maintain Personal Information from individuals we actually know are under 16 years of age, and no part of the Services is designed to attract individuals under 16 years of age. If we later learn that a user is under 16 years of age, we will take steps to remove that user's Personal Information from our databases and to prevent the user from utilizing the Services.

6. RETENTION

We retain personal information for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes.

If you request to delete your account, we will retain your information for a period of one (1) year to allow you to reinstate your account in case you change your mind and wish to reinstate your account. After a period of one (1) year, your information will be anonymized by removing your Personal Information. Your Personal Information will then be deleted.

If you do not log in to the Site for a period of five (5) years, we will consider your account inactive and your information will be anonymized by removing your Personal Information. Your Personal Information will then be deleted.

If either deletion or anonymization according to the foregoing time frames is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible. If we anonymize your Personal Information (so that it can no longer be associated with you), we may use this information indefinitely without further notice to you.

We are committed to protecting the security of your Personal Information. While we take steps to help ensure the integrity and security of our network and systems, including employing certain physical, administrative, and technical security measures, we cannot guarantee our security measures.
