Digiphy.it Corporation (“Digiphy”) is committed to safeguarding your information. We understand the importance of privacy and want you to make an informed decision about sharing information with us when visiting our website and using our services.

This privacy policy (“Privacy Policy”) describes the services offered through the Digiphy website at www.digiphy.it (the “Site”) and how we collect, use, share, and protect personal information we obtain through the Site. We will refer to the Site and related products and services offered through the Site as the “Services.” This Privacy Policy applies to all visitors, users, and others who access the Services, including brands who use Digiphy to promote their products, and individuals who visit the Site or related Services or contact Digiphy support.

Please read the Privacy Policy carefully to understand our practices regarding your information and how we will treat it. By visiting the Site and/or using the Services, you acknowledge that the collection, use, and sharing of your information will take place as described in this Privacy Policy.

So we are clear about the terminology we are using, when we use the phrase “Personal Information” in this Privacy Policy, we mean information about an individual that (either by itself or when combined with information from other available sources) allows that individual to be identified, including, your name, address, telephone number, or e-mail address. When we use the phrase “Anonymized Information” in this Privacy Policy, we mean information that does not allow for the identification of an individual or is not associated with or linked to your Personal Information. Anonymized Information does not enable identification of or contact with individuals.

1. INFORMATION WE COLLECT

We collect information in several ways to digitally connect our brand customers (each a “Partner Brand”) with their consumers, and to enhance our users’ experience with Digiphy. If you are a consumer of one of our Partner Brands, we collect, process, and use information about you when you: opt-in to our Services or create an account with us; connect to our Services through third parties, including social media accounts and our Partner Brands; interact with our Services, with third parties who refer you to our Services, or with Partner Brands who participate in our Services; or contact us for support.

Personal Information you may provide to us or our Service Providers (defined below) through the Services includes:

INFORMATION WE OBTAIN FROM OTHERS

Information we obtain from social media platforms. We may maintain pages for Digiphy on social media platforms, such as Facebook, LinkedIn, Twitter, Google, YouTube, Instagram, and other third-party platforms. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use and processing of your Personal Information in accordance with your privacy settings. You or the platforms may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy.

Information we obtain from other third parties. We may receive Personal Information about you from third-party sources. For example, a Partner Brand may share your contact information with us if you have expressed interest in or may benefit from our Services. We may obtain your Personal Information from other third parties, such as marketing partners, publicly available sources and data providers.

COOKIES, WEB BEACONS, AND OTHER INFORMATION COLLECTED BY AUTOMATED MEANS

We, our Service Providers, and our business partners may automatically log information about you, your computer or mobile device, and activity occurring on or through the Services. The information that may be collected automatically includes your computer or mobile device operating system type and version number, manufacturer and model, device identifier, browser type, screen resolution, IP address, the website you visited before browsing to our website, general location information such as city, state or geographic area; and information about your use of and actions on the Services, such as pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, and length of access. Our Service Providers and business partners may collect this type of information over time and across third-party websites and mobile applications. On our Site, this information is collected using cookies, browser web storage, web beacons, and similar technologies, and our emails may also contain web beacons to determine whether users open or act on our communications.

You can control cookies through your browser or operating system settings, but by doing so, you may not be able to use certain features on the Site or take full advantage of all of our Services.

DO NOT TRACK

2. HOW WE USE YOUR INFORMATION

We use the information that we have about you to provide, support, personalize, and make our Services more relevant and useful to you and others. How we use your information will depend on the Services you use.

We may use the information we collect from and about you: (1) to establish and manage your account and/or your profile; (2) to provide, operate, deliver, and improve the Services to you, including processing payments for Services that require them; (3) to allow you to engage with our Partner Brands and/or participate in Partner Brands’ offers or transactions of your choice; (4) to communicate with you, including about our Services and/or the products and services of our Partner Brands, to provide customer support, to send marketing communications, and to respond when you contact us; (5) with your consent; (6) to create anonymous, aggregated or de-identified data; (7) to deliver ads; (8) as we believe necessary or appropriate, to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities; and/or (9) to protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.

To the extent we deliver marketing emails, you may change your communication preferences to opt out of marketing emails, but please be aware that you cannot opt out of receiving service messages from us, including security and legal notices.If you opt in to one of our Partner Brand campaigns, you may provide us with your mobile phone number and expressly consent and opt in to receive certain text or SMS messages (“SMS Messages”) from or on behalf of the subject Partner Brand and/or from Digiphy on such Partner Brand’s behalf related to the campaign Digiphy through your wireless provider to the mobile number you provided. In that case, Digiphy collects and processes your mobile telephone number data solely on behalf of the Partner Brand and subject to an agreement between Digiphy and the Partner Brand, with Digiphy acting as a service provider of the Partner Brand and pursuant to the Partner Brand’s instructions. We do not sell, share, or otherwise process your mobile telephone number data with any other third-party and/or for any reason or purpose other than to provide services to the Partner Brand. You may opt out of these SMS and other such messages from Digiphy by removing your mobile number in your account preferences or replying STOP to any incoming messages.

3. HOW WE SHARE YOUR INFORMATION

Partner Brands use our Services to connect and engage with their customers, and vice versa. We may share certain Personal Information we collect from and about you (1) if you are a consumer, with our Partner Brands, to enable and fulfill your participation in Partner Brands’ offers or transactions of your choice, as well as to provide them with our Services and with analytics regarding audience engagement with their products and product materials; (2) if you are a Partner Brand, with our business or marketing partners, with your consent; (3) for legal and safety purposes, including in response to lawful requests by public authorities to meet national security, law enforcement, or other requirements; (4) to protect the rights of Digiphy, our agents, customers, and others, including by enforcing our agreements and policies; (5) with a new owner if the ownership or control of all or part of our Services changes; and/or (6) with third parties we contract with to perform functions related to the Services (“Service Providers”). Service Providers will have access to your Personal Information needed to perform their business functions, but may not use or share that Personal Information for purposes outside the scope of their functions related to the Services.

Please note, if you are a consumer, we will rely expressly on your direction and opt-in consent with respect to the disclosure of your Personal Information to one or more Partner Brands. This consent can be withdrawn at any time, but once the information has been passed to a Partner Brand, that information cannot be retrieved. To the extent you also opt in to receiving electronic communications, including e-mail messages, chat messages, text messages, SMS Messages, and/or multimedia messaging service a/k/a MMS from one or more of Digiphy’s Partner Brands, your communications with such Partner Brands will be governed by the Partner Brands’ terms of service and/or privacy policy and you will need to separate opt out of any such electronic communications directly with the Partner Brands. You understand and agree that, once you have opted in, Digiphy has no control over electronic communications to you from or on behalf of Partner Brands, does not have the ability to opt out of Partner Brands’ electronic communications on your behalf, and disclaims any liability associated with or arising from such electronic communications.

We do not sell or share your Personal Information except as provided in the preceding paragraphs and we do not use or disclose your Personal Information for ad targeting by third parties. In particular, your mobile information will not be sold or shared with third parties for promotional or marketing purposes. Digiphy collects and processes your mobile telephone number data solely on behalf of the Partner Brand and subject to an agreement between Digiphy and the Partner Brand, with Digiphy acting as a service provider of the Partner Brand and pursuant to the Partner Brand’s instructions. We do not sell, share, or otherwise process your mobile telephone number data with any other third-party and/or for any reason or purpose other than to provide services to the Partner Brand.

4. LINKS TO OTHER SITES

The Services may contain links to other third-party sites, including the sites of our Partner Brands. Any information you provide on those sites is subject to that third party’s privacy policy. Our Privacy Policy does not apply to such sites, and we are not responsible for the privacy and security practices and policies of those third-party sites.

5. CHILDREN

The Services are not directed to children and children are not eligible to use the Services. We do not collect or maintain Personal Information from individuals we actually know are under 16 years of age, and no part of the Services is designed to attract individuals under 16 years of age. If we later learn that a user is under 16 years of age, we will take steps to remove that user's Personal Information from our databases and to prevent the user from utilizing the Services.

6. RETENTION

We retain personal information for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes.

If you request to delete your account, we will retain your information for a period of one (1) year to allow you to reinstate your account in case you change your mind and wish to reinstate your account. After a period of one (1) year, your information will be anonymized by removing your Personal Information. Your Personal Information will then be deleted.

If you do not log in to the Site for a period of five (5) years, we will consider your account inactive and your information will be anonymized by removing your Personal Information. Your Personal Information will then be deleted.

If either deletion or anonymization according to the foregoing time frames is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible. If we anonymize your Personal Information (so that it can no longer be associated with you), we may use this information indefinitely without further notice to you.

7. SECURITY OF YOUR PERSONAL INFORMATION

We are committed to protecting the security of your Personal Information. While we take steps to help ensure the integrity and security of our network and systems, including employing certain physical, administrative, and technical security measures, we cannot guarantee our security measures.

8. DATA PROCESSING AND DATA RIGHTS

We use your Personal Information above only as permitted by law. Our legal bases for processing the Personal Information described in this Privacy Policy are described in the table below. We do not make any decisions by automatic means.

These activities constitute our legitimate interests. We do not use your Personal Information for these activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).

To comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities

Processing is based on your consent. Where we rely on your consent you have the right to withdraw it any time in the manner indicated when you consent or in the Services.



Certain privacy laws, like the California Consumer Privacy Act (CCPA), the EU General Data Protection Regulation, and the UK General Data Protection Regulation, provide rights to individuals located in certain areas about their Personal Information. 

If you are in California, you may have privacy rights including:

- Access Data: You may have the right to receive a copy of Personal Information we have collected about you over the past 12 months including: categories of Personal Information we have collected about you; categories of sources from which the Personal Information has been collected; the business or commercial purpose for collecting your Personal Information; the categories of third parties with whom we have shared your Personal Information; and the specific pieces of Personal Information we have collected about you.

-Request Deletion of Data: You may request that we delete information we have collected about you.

-Non-discrimination: You may have the right not to be discriminated against for exercising any of these rights.

If you are based within the EU, in certain circumstances you will also have the following rights:

9. CHANGES TO OUR PRIVACY POLICY

We may modify this Privacy Policy from time to time. If we make any changes, we will change the Last Updated date above. We also may provide additional notice, as applicable, depending on the type of change. If you object to any changes, you may stop using the Services. Your continued use of the Services after we publish or otherwise provide notice about our changes to the Privacy Policy means that you have read and understood the updated Privacy Policy.
